Draft delegated Decision on the carbon leakage list for 2021-2030 open for stakeholder feedback

The preliminary carbon leakage list published in May 2018 presented the result of the first-level assessment (sectors directly qualifying for the 2021-2030 carbon leakage list at NACE-4 level on the basis of the criteria laid down in the EU ETS directive) and listed the sectors and sub-sectors eligible to apply for the second-level assessment. All second-level assessments, including quantitative disaggregated and qualitative assessments, were finalized in September 2018.

In the preparatory phase, the Commission held two public consultations and a number of bilateral meetings with industry and other stakeholders. The draft delegated decision presents the outcome of both the first and second-level assessments.

As a result of the new, combined assessment criteria, a carbon leakage list has been established.  The new carbon leakage list will cover the entire 10-year period of Phase 4 of the EU ETS, thus providing regulatory certainty to industry sectors.

The Commission will adopt the delegated act after the 4-week stakeholder feedback period and then submit it to the European Parliament and Council for two months' objection period. The Commission Decision will then be published and will enter into force on the following day after the publication, provided no objections are raised.
